Vets Cars, LLC Terms of Service

General

This information defines the Terms of Service and operating policy of Vets Cars, LLC, an Oklahoma limited liability company (the “Company”) the owner of www.vetscars.com and www.vets-cars.com, plus affiliated websites (collectively the “Service”) designed to support American Veterans and their families (the “Veteran” or “Veterans”) and members of the automobile industry that seek to provide special benefits to those Veterans (the “Dealer” or “Dealers”). These Terms of Service will be governed by the laws of the State of Oklahoma. The United States Department of Defense is not affiliated with the Company.

Privacy

This online privacy notice discloses the Company’s information practices for the use of the Service on this website, including what type of personal identifiable information id requested, how the information is used, and with whom the information is shared.  The Service is intended to assist U.S. military Veterans and their families, 18 years of age or older, who agree to be bound by U.S. laws governing website usage and the policy expressed herein. The purpose of the Company is to connect Veterans with appropriate Dealers. To support such relationships requires the Company to provide Dealers with private information collected from Veterans using the Service, and to provide Veterans with  information from Dealers. Any participant in the Company’s Service has the right to withhold any private information, or to request that the Company remove or withhold it from other parties, by writing to info@vetscars.com. However, the Company reserves the right to retain private information and use it for statistical and market research purposes.

Personal Information that maybe Collected

In order to use the Service, the Company will request a Veteran to provide certain personal identifying information, which may include: legal name, postal address, email address, telephone number, method of payment, and if applicable, credit card number.  The Company may request additional information necessary to establish and maintain customer’s account.  The Company does not provide the Service to children and will not collect or post information from a child under the age of 18 without the involvement of a parent or guardian.  The Company may collect personal identifying information from Veterans during a transaction.  The Company may extract some personally identifying information about that transaction in a non-identifiable format and combine it with other non-identifiable information.  This information is used and analyzed only at an aggregate level to help the Company understand trends and patterns.

Use of Personal Information

The information you provide to the Company may be collected, used, analyzed and/or processed by the Company, or Dealers, for marketing and other business purposes.

Disclosure of the Information

The Company may share your personal information within the Company’s corporate organization.  Circumstance may arise where for business reasons the Company decides to sell, buy, merge or otherwise reorganize its businesses.  Such a transaction may involve the disclosure of personal identifying information to prospective or actual purchasers.  It is the Company’s practice to seek appropriate protection for information in these types of transactions.  The Company reserves the right to disclose to third parties personal information about Veterans for marketing analysis.  Under certain circumstances, personal information may be subject to disclosure pursuant to a judicial or other government subpoenas, warrants or orders.

Collection of Non-Identifying Information

The Company may collect non-identifiable information from Veterans’ visits to the Company’s website in order to provide better customer service.  Examples of such collecting include but are not limited to: traffic analysis, such as tracking of the domains from which Veterans visit, or tracking numbers of visitors; measuring visitor activity on the Company’s website; website and systems administration; Veterans’ analysis; and business decision making.

Information Security

The Company employs physical, electronic and managerial procedures to safeguard the security and integrity of personal information.  Billing and payment data is encrypted whenever transmitted or received online.  Personal information is accessible only by staff designated to handle online requests or complaints.  All Company agents with access to personal information on the Company’s website are bound to adhere to the Company security standards.  The Company will exercise all reasonable efforts to safeguard the confidentiality of Veterans personal information.  However, transmissions protected by industry standard security technology and implemented by humans cannot be made absolutely secure.  Consequently, the Company shall not be liable for unauthorized disclosure of personal information due to no fault of the Company, including but not limited to, errors in transmission and unauthorized acts of third parties.

Privacy Policy Changes and Opt-Out Rights

The Company reserves the right to change or update its privacy policy statement at any time.  A notice of such change or notice of any material change will be posted on the Company’s website.  Veterans using the site will have the right at any time to cease permitting personal information to be collected, used or disclosed by the Company or third parties with whom the Company has shared such personal information.  Right of cancellation may be exercised by contacting the Company at info@vetscars.com.

Intellectual Property

The information (collectively, the “Content”) within the Service are intended to facilitate vehicle-purchase relationships between Veterans and Dealers. The Content is owned by the Company and used by its affiliated companies, licensors, licensees, and suppliers, and is protected by copyright and other intellectual property laws. Participating Veterans and Dealers may not reproduce, sell, publish, distribute, modify, display, repost or otherwise use any portion of the Content without the written consent of the Company. Requests regarding use of the Content for any purpose other than as defined herein should be directed to info@vetscars.com.

Operators of websites that wish to link to the Service must link to the Service’s home page at www.vetscars.com unless permission to do otherwise has been granted in writing by the Company, which reserves the right to reject or terminate any links to the Content or the Service.

Disclaimer and Liability

INFORMATION ON VEHICLES, DEALERSHIPS, AND TRANSACTIONS PROVIDED BY THE SERVICE IS SUPPLIED BY THIRD PARTIES, AND THE COMPANY CANNOT WARRANT THE ACCURACY OR COMPLETENESS OF THAT INFORMATION. THE SERVICE IS PROVIDED ON AN “AS IS” BASIS, AND THE COMPANY MAKES NO REPRESENTATIONS OR WARRANTIES TO ANY VETERAN OR DEALER AS TO THE ACCURACY OR COMPLETENESS OF ANY INFORMATION ABOUT A VEHICLE DESCRIBED VIA THIS SERVICE, OR ABOUT THE CAPACITY AND INTEREST OF A PARTICIPATING VETERAN, SO RELIANCE UPON ANY SUCH PERSONAL INFORMATION SHALL BE AT THE SOLE RISK OF VETERANS AND DEALERS. VETERANS USING THE SERVICE AGREE TO HOLD THE COMPANY HARMLESS AND INDEMNIFY IT FROM LIABILITY ARISING FROM INCORRECT, INCOMPLETE, FALSE OR MISLEADING INFORMATION REGARDING ANY VEHICLE, DEALERSHIP, AUTOMOTIVE SERVICE, VETERAN, OR TRANSACTION SUPPORTED OR INITIATED BY THE SERVICE.
